Main window accessibility under Snow Leopard

When launched in Mac OSX Snow Leopard the main window is drawn under the main top panel. Test but it seems to be related to Mac OS since in Lion it works properly

I have to precise one thing.. also on Mac OS Lion happens the same thing: the GUI appeares in the top left corner and under the main panel. The difference lays on the fact that while in Snow Leopard the GUI remains there, under Lion the GUI, once launched, "understand" that it is under the main panel and then moves itself immediately down (at the end the top horizontal border of the guy is tangent to the main panel).
