What’s the underlying IP for NNWs?
The license is drafted with a sole focus on IP rights a contributor may have over any NNW. Which IP rights actually apply to NNWs?
Copyright - NNWs aren’t human authored. NNWs also don’t fit into any existing copyrightable subject matter bucket.
Trade Secret - Everything about the license is open, including the models. This method of distribution immediately kills any trade secret protections.
Patent - Out of my area of expertise, but I understand that for this particular project, it wouldn’t apply.
Then, the next question is how would this actually be enforceable under IP rights if no use of NNWs is capable of involving an infringement?
What’s the project focus?
I’m also confused because the project documentation is heavily focused on NNWs, but then the definition and license scope goes beyond those to include entire models and, in the case of the license, the “software, data, or other material that is designated as being available under this license.”
Why are these additional materials/artifacts necessary to cover under this license structure? The README states: “The misconception stems from conflating two different artifacts - software source code and NNWs.” If that’s the case, then wouldn’t traditional OSS, open data, or CC licenses be applicable to the other artifacts/materials aside from the NNWs?
