I'd recommend taking a look at the Data Rights Section from the interagency agreement between the Veterans Health Agency and the Defense Health Agency if you have not done so already. My understanding is that this language was vetted and approved by both VA and DoD contracting/legal. This language addresses source code + related artifacts while taking "proprietary, protected, or sensitive information or content" into consideration.
